NZNO would value your feedback on legislation that proposes to make it an offence to post intimate visual recordings of another person online.
Often referred to as revenge pornography, this form of sexual exploitation involves the intentional, non-consensual disclosure of intimate visual recordings of another person who is either naked, exposed, or engaged in an intimate sexual activity. It constitutes the extreme end of online harassment to which nurses are subject in higher numbers than many other groups (D’Souza, N., Forsyth, D., Tappin, D., & Catley, B. 2018)
Since its enactment in 2015 the Harmful Digital Communications Act has been criticised for setting thresholds and definitions of harm too high resulting in few prosecutions and denying justice to those seriously affected by the online conduct of others.
